Terms
What you are buying, in plain terms.
These terms apply to work commissioned from Kallo. They are meant to be legible: if a clause below is unclear, ask before you accept a quote rather than after.

Who you are contracting with
Kallo is a trading brand of Velocia Group Corporation, a Delaware corporation at 1007 N Orange St, 4th Floor, Ste 1382, Wilmington, New Castle, Delaware 19801. Your contract is with that company.
What a commission covers
Each commission is tailored to your project. The proposal sets out the agreed still images, video, fly-throughs or other visual work, the files we will work from, and the intended use of the finished work.
The proposal confirms the number of views, the visual direction, any preparation work required and the delivery date. Additional views, site context, animation, film or other changes to the agreed scope are quoted before that additional work begins.
The appearance of the finished work is agreed in your brief. Finished visuals are presentation material; they do not replace dimensioned drawings or verified views.
What we need from you
The plans, model and reference material agreed in the brief, and the authority to use them. By sending files you confirm you hold the rights in them, or have permission from whoever does, to use them for the commissioned work.
If a file will not carry what you have asked for, we tell you before anything is quoted or charged. Reviewing your file costs nothing.
Confidentiality and how your files are handled
Your project files and the images and video derived from them are confidential. We store them privately, use them only to produce your commission, and never publish, resell, share or demonstrate them without your written approval.
That includes our own marketing. Your project does not appear in a portfolio, a case study, a pitch or a social post unless you have told us in writing that it may.
A non-disclosure agreement can be signed before any transfer, and secure upload instructions are supplied before you share a file. Either is available on request and neither delays a quote.
You may ask us to delete your files at any point after delivery, and you may agree a project-specific deletion date before anything is sent. We will confirm either in writing.
Revisions and turnaround
A commission includes one consolidated revision round. Consolidated means one set of comments covering everything, rather than a sequence of single changes, which is how a revision stays included rather than becoming a new commission.
The delivery date is agreed in your proposal and depends on the scope and the files you supply. Any additional preparation work required is quoted separately before it starts.
Who owns the delivered work
On full payment, you own the delivered images and video and may use them however your project requires, including marketing, listings, submissions and publication.
You keep everything you already owned. Sending us plans, models or reference files transfers no rights in those files themselves.
Images are labelled with relevant limitations. Dimensions in an image are approximate; your original drawings remain the reference for measurements and construction.
Quotes, currency and payment
Every commission is quoted as a fixed figure with a delivery date before work begins. The quote states its own currency, and that is the currency you are charged in. New Zealand, Australian and United States clients are each quoted in their own.
When a payment is due, we send you a secure payment link for a fixed amount set out in your quote, and you pay that amount in full by card through our payment processor. Final files are delivered once the invoice is settled. Any tax that applies is shown on the quote.
Refunds and cancellations
A refund is paid back to the card the payment was made with.
If you need to change or cancel an order after it is placed, tell us as early as you can and we will deal with it in writing rather than by silence.
If something goes wrong
If the delivered work does not match the brief we agreed, tell us and we will correct it. That is the remedy, and it is one we would rather give than argue about.
Beyond correcting the work, our liability for any commission is limited to what you paid for it. We are not liable for indirect or consequential loss, such as a missed submission deadline, where the cause was outside our control.
Governing law
These terms are governed by the laws of the State of Delaware, United States.
